Welcome to Work & Worker.

These Terms & Conditions (“Terms”, “Terms & Conditions”, “Agreement”) govern your access to and use of the Work & Worker website and related services.

By accessing, registering on, submitting information to or otherwise using Work & Worker, you agree to these Terms.

If you do not agree with these Terms, please do not use the platform.

1. About Work & Worker

Work & Worker is an online platform designed to facilitate connections between:

  • Job Seekers and Job Providers;

  • Work Seekers and Work Providers; and

  • other users interested in finding or offering work.

Work & Worker is a platform and does not itself guarantee employment, work, payment, hiring, selection or any particular outcome.

2. Definitions

For these Terms:

“Platform” means the Work & Worker website and related services.

“User” means any person accessing or using the Platform.

“Job Seeker” means a person seeking employment or a job opportunity.

“Work Seeker” means a person seeking work, assignments, services, contracts or similar opportunities.

“Job Provider” means a person, business or organisation offering a job.

“Work Provider” means a person, business or organisation offering work, assignments, services or similar opportunities.

“Profile” means information submitted by a user about themselves.

“Listing” means a job offer, work offer or other opportunity submitted to the Platform.

“User Content” means information, text, images, descriptions or other material submitted by users.

3. Eligibility

You may use Work & Worker only if you are legally capable of entering into an agreement under applicable law.

You must provide truthful information when registering or submitting information.

If you are not legally permitted to use a particular service, you must not use that service.

4. Registration

Where registration is required, you agree to:

  • provide accurate information;

  • keep your information reasonably current;

  • provide information that you have the right to submit;

  • protect your account credentials;

  • not impersonate another person; and

  • notify us if you believe your account has been misused.

 

You are responsible for activity conducted through your account to the extent permitted by law.

5. Accurate Information

Users must not knowingly submit information that is:

  • false;

  • materially misleading;

  • fraudulent;

  • impersonating another person;

  • designed to deceive;

  • unlawfully copied from another person; or

  • otherwise unlawful.

Work & Worker may review, restrict or remove information that appears to violate these Terms.

6. Job Seekers and Work Seekers

Seekers are responsible for ensuring that information in their profiles is accurate.

Seekers should not:

  • misrepresent qualifications;

  • falsely claim experience;

  • impersonate another person;

  • provide fraudulent documents;

  • misrepresent their availability;

  • submit another person's information without permission; or

  • use the Platform for unlawful purposes.

7. Job Providers and Work Providers

Providers are responsible for ensuring that their listings are accurate and lawful.

Providers must not:

  • publish fake opportunities;

  • falsely represent an organisation;

  • misrepresent salary or remuneration;

  • demand unlawful payments;

  • collect personal information unnecessarily;

  • discriminate unlawfully;

  • harass users;

  • impersonate another organisation;

  • publish misleading work information;

  • use the Platform for scams; or

  • use the Platform for unlawful activities.

8. Job and Work Listings

Work & Worker may permit users to submit:

  • Job Offers;

  • Work Offers;

  • job descriptions;

  • work descriptions;

  • worker requirements;

  • qualifications;

  • location information;

  • remuneration information; and

  • other relevant information.

 

Work & Worker does not guarantee that any listing is accurate, genuine, suitable, lawful or currently available.

 

Users should independently verify important information before entering into any agreement.

9. Public Profiles and Listings

Certain information may be displayed publicly.

Users understand that publicly displayed information may be accessible to website visitors and potentially copied or shared by third parties.

Work & Worker does not guarantee that third parties will use publicly available information only for legitimate purposes.

10. Work Seeker Contact Information

Work & Worker generally does not publicly display a Work Seeker's personal phone number on the Work Seeker's public profile.

Where a Work Provider wishes to contact a Work Seeker, Work & Worker may require the Provider to contact our team and provide the relevant Worker/Seeker ID.

Work & Worker may review the request before deciding whether to provide contact information.

Providing contact information is not automatic and may be subject to verification, consent, safety considerations, legal requirements and other applicable factors.

11. Work Provider Contact Information

A Work Provider may choose to provide contact information for publication.

Where the Provider has agreed to public display, that contact information may be displayed so that Work Seekers can contact the Provider.

 

Providers should not submit personal contact information for publication unless they are comfortable with that information being publicly accessible.

12. Prohibited Activities

Users must not use Work & Worker to:

  1. commit or facilitate unlawful activities;

  2. create fake profiles;

  3. impersonate another person or organisation;

  4. publish fraudulent job or work opportunities;

  5. scam or defraud another user;

  6. harass or threaten another user;

  7. collect information for unlawful purposes;

  8. scrape or automatically harvest profile information without permission;

  9. send spam;

  10. distribute malware;

  11. attempt to compromise the Platform;

  12. interfere with the operation of the website;

  13. circumvent security measures;

  14. misuse contact information;

  15. publish information belonging to another person without appropriate authority;

  16. upload unlawful content;

  17. infringe intellectual property rights;

  18. exploit children;

  19. promote illegal activities;

  20. mislead users regarding employment or work opportunities;

  21. request unnecessary sensitive information;

  22. use the Platform for phishing or credential theft; or

  23. otherwise violate applicable law.

13. Contact Information Misuse

If Work & Worker provides a Work Seeker's contact information to a Work Provider through an authorised process, the information must be used only for legitimate purposes connected with the relevant work opportunity.

The recipient must not:

  • sell the information;

  • publish it;

  • distribute it to unrelated third parties;

  • use it for spam;

  • use it for harassment;

  • use it for unrelated marketing; or

  • otherwise misuse it.

14. Scraping and Automated Collection

Without our express permission, users must not use automated systems, bots, scripts, crawlers or similar technologies to:

  • scrape profiles;

  • collect phone numbers;

  • collect email addresses;

  • collect user databases;

  • reproduce listings;

  • systematically copy Platform content; or

  • interfere with the Platform.

 

Work & Worker may take technical and legal measures against unauthorised automated collection.

15. User Content

Users retain rights they may have in content they submit, subject to applicable law.

By submitting content to Work & Worker, you grant us the permissions reasonably necessary to host, store, reproduce, display, format and otherwise use that content for operating and providing the Platform.

 

You represent that you have the right to submit the content.

16. Intellectual Property

The Work & Worker name, logo, website design, software, graphics, text, branding and other original Platform materials may be protected by intellectual property laws.

Except as permitted by law or with our written permission, users must not:

  • copy;

  • reproduce;

  • modify;

  • distribute;

  • sell;

  • publish;

  • create derivative works from; or

  • commercially exploit

Work & Worker's proprietary materials.

17. Third-Party Services

The Platform may rely on third-party services.

Third-party services may have separate terms and policies.

 

Work & Worker is not responsible for third-party services that we do not control.

18. Verification

Work & Worker may, where appropriate:

  • review profiles;

  • review listings;

  • request additional information;

  • contact users;

  • investigate complaints;

  • verify certain information; or

  • restrict suspicious activity.

 

However, users understand that Work & Worker cannot guarantee that every profile, person, business, opportunity or piece of information has been independently verified.

19. No Employment Guarantee

Work & Worker does not guarantee:

  • employment;

  • selection;

  • interview;

  • salary;

  • payment;

  • work availability;

  • work quality;

  • hiring;

  • business relationships;

  • contracts; or

  • any other outcome.

 

The relationship between users is established independently of Work & Worker unless expressly stated otherwise.

20. User-to-User Transactions and Relationships

Users are responsible for evaluating other users before:

  • accepting work;

  • offering work;

  • paying money;

  • sharing sensitive information;

  • travelling to a location;

  • signing an agreement; or

  • entering into any other relationship.

 

Work & Worker is not responsible for the conduct of users outside the Platform except to the extent required by applicable law.

21. Payments

Unless expressly stated otherwise, Work & Worker does not guarantee, process or control payments between users.

Users should independently establish:

  • remuneration;

  • payment terms;

  • contracts;

  • invoices;

  • taxes;

  • expenses; and

  • other financial arrangements.

 

If Work & Worker introduces payment functionality in the future, additional terms may apply.

22. Fraud and Suspicious Activity

Users must report suspected:

  • fake profiles;

  • fake job offers;

  • fake work offers;

  • impersonation;

  • scams;

  • harassment;

  • fraud;

  • misuse of contact information; or

  • other suspicious activity.

Work & Worker may investigate reports and take appropriate action.

23. Removal of Content

Work & Worker may remove, restrict, suspend or disable access to content, profiles or listings where we reasonably believe that they:

  • violate these Terms;

  • violate applicable law;

  • create a security risk;

  • involve fraud;

  • create risk to users;

  • contain misleading information;

  • involve abuse; or

  • otherwise misuse the Platform.

Where required by applicable law, we may take additional action or provide appropriate notice.

24. Suspension or Termination

We may suspend or terminate an account or restrict access where:

  • these Terms are violated;

  • unlawful activity is suspected;

  • fraud is suspected;

  • the account poses a security risk;

  • information is materially false;

  • the Platform is being abused; or

  • required by law.

 

Users may stop using the Platform at any time.

25. Platform Availability

We try to keep Work & Worker available and functional.

 

However, we do not guarantee that the Platform will:

  • always be available;

  • always operate without errors;

  • be uninterrupted;

  • be free from vulnerabilities;

  • be compatible with every device; or

  • always contain complete or current information.

 

Maintenance, technical problems, security incidents or circumstances outside our reasonable control may affect availability.

26. Disclaimer

Work & Worker provides a platform for connecting users.

Information submitted by users belongs to those users and may not have been independently verified.

 

We do not endorse every user, listing, opportunity, claim, qualification or representation appearing on the Platform.

 

Users must conduct their own due diligence.

27. Limitation of Liability

To the maximum extent permitted by applicable law, Work & Worker will not be responsible for indirect, incidental, consequential, special or similar losses arising from:

  • interactions between users;

  • employment or work relationships;

  • fraudulent users;

  • inaccurate user information;

  • missed opportunities;

  • loss of business;

  • unauthorised third-party use of information;

  • user-generated content; or

  • interruptions to the Platform.

 

Nothing in these Terms excludes liability that cannot legally be excluded.

28. Indemnity

To the extent permitted by applicable law, a user may be responsible for losses, claims or expenses arising from:

  • violation of these Terms;

  • unlawful use of the Platform;

  • infringement of another person's rights;

  • fraudulent activity;

  • misuse of user information; or

  • content submitted by the user.

29. Privacy

Your use of Work & Worker is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, process, store and disclose personal information.

30. Safety

Users should read our Safety & Fraud Awareness Policy before interacting with other users.

Users should never provide:

  • OTPs;

  • UPI PINs;

  • passwords;

  • banking credentials;

  • card PINs;

  • unnecessary identity documents; or

  • other confidential authentication information

to another user merely because they contacted them through Work & Worker.

31. Complaints and Grievances

Complaints may be submitted to:

We will handle complaints in accordance with applicable law and our procedures.

32. Changes to These Terms

We may update these Terms from time to time.

The updated Terms will contain a new “Last Updated” date.

Where required, we may provide additional notice.

Continued use of the Platform after applicable changes take effect may constitute acceptance of the updated Terms to the extent permitted by law.

33. Governing Law

These Terms shall be governed by the laws of India.

Subject to applicable law, disputes shall be subject to the jurisdiction of the competent courts and authorities having jurisdiction.

34. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to the extent permitted by law.

35. Entire Agreement

These Terms, together with the Privacy Policy and other applicable policies published by Work & Worker, constitute the applicable agreement governing use of the Platform, subject to mandatory requirements of law.
